GCH Technologies Inc. (GCH, we, us, our), takes the protection of your Personal Data seriously. GCH is a telecommunications company based in Delaware. GCH supports the advancement, innovation, and success of the wireless communications industry here in the United States. Our pursuit of excellence includes our commitment to protecting your privacy rights in accordance with applicable law. GCH wants individuals interacting with us to have clarity regarding our processing of Personal Data and to trust that our processing and use of Personal Data is consistent with the law and industry best practices. GCH is a business-to-business consulting and technology company that provides innovative and transformative solutions to the telecommunications industry (our Services). GCH serves as a neutral party to the telecommunications industry and is dedicated to advancing the wireless ecosystem in the United States. GCH prioritizes transparency, sustainability, effectiveness, and efficiency in our Services. Protecting the privacy and security of Personal Data is part of our culture of transparency and sustainability, which includes GCH's processing of the Personal Data provided to us by you – our Clients, Client Data Subjects, Job Applicants, and Site Visitors.

This Privacy Notice (Notice) will provide you with information about the Personal Data we collect, how we process or use it, and how, where applicable, you may exercise your rights related to your Personal Data in the context of your relationship with GCH. Please review this Notice fully, noting your relationship with GCH either as a recipient of the Services GCH provides (Client), a client or user of services from a GCH Client, for whom GCH may provide services on its behalf (a Client Data Subject), a job applicant or prospective job applicant (Job Applicant) or a visitor to this Site (Site Visitor). Note that who you are in relation to GCH determines the data GCH processes.

Important Note:

This Privacy Notice does not apply to Personal Data of GCH Client Data Subjects where GCH acts as a Processor on behalf of our Client and process your Data according to their instructions. If in this context we process your Personal Data, you are a Client Data Subject of the GCH Client, and must direct your questions regarding the use or processing of your Personal Data to that GCH Client.

Contents of this Notice

A. What is Personal Data?

The term Personal Data refers to a broad scope of information about any individual person. Data protection and privacy laws (Privacy Laws) define Personal Data in different ways, but generally, Personal Data refers to any data that can be used directly or indirectly, alone or in combination with other data, to identify a living person. This is how GCH defines and uses the term Personal Data (also Data, Personal Information, or your information) in this Notice. For example, a person's cell phone number is considered their Personal Data, while a company's telephone number is not the personal data of the company.

Most Privacy Laws distinguish between the roles an entity may play in their processing of Personal Data. As noted above, the entity which sets the rules for how Personal Data is processed or used is the Controller, while other entities, which may process Personal Data on behalf of a Controller, are referred to as Processors (or Service Providers). A Controller decides why and how to process Personal Data. A Processor does not make decisions about the purposes of the processing of Personal Data; it merely processes or uses Data for the Controller according to the Controller's instructions.

B. Scope of this Notice

This Notice does not apply to Personal Data of Client Data Subjects where GCH acts as a Processor.

As mentioned above, GCH is a business-to-business consulting company, serving the wireless telecommunications industry in the United States. Our Services include the provision and access to our website www.gchtech.com (Site), as well as the provision of technology, operational, and consulting services on behalf of the governing entity for the U.S. telecommunication industry (collectively, our Services). GCH's processing of your Personal Data depends on how we interact and what relationship we have with you.

GCH Client

A business that has directly entered into an agreement with GCH to assist in the provision of that business's services.

Job Applicants

Individuals who come to the Site to apply for employment directly with GCH.

Site Visitors

Individuals who access the Site.

Client Data Subjects

Clients or users of services from a GCH Client, for whom GCH may provide services on its behalf.

C. How GCH Uses Personal Data

In most of GCH processing activities, GCH is providing its Services on behalf of its Clients and will be acting as a Processor of Data collected or processed in that capacity, such as any contact information, email communications, status of a project, or information related to our execution of certain Services on behalf of each Client. Where GCH acts as a Processor on behalf of its Clients, the Client entity's own privacy terms and policies will apply to Data GCH processes on its behalf.

C.1. Client Data Subjects – GCH is also a Processor

GCH Clients may contract with us to provide services on their behalf, including processing Personal Data according to the Client's instructions, as a Processor. A GCH Client may have used GCH Services during your interaction with the Client entity or to process Data related to your interaction with Client. If so, you are a Client Data Subject, the Client entity is the controller of your Data, and we came into play as the Processor of that Data. Any Personal Data generated during these interactions is a part of the Client entity account with us, and is governed by that organization's policies, not ours. Please direct any privacy inquiries to the GCH Client organization's administrator.

As stated in Section B, above, GCH's processing of Client Data Subject Personal Data is not in scope for this Privacy notice. Such processing activity is not discussed or addressed further in this Notice.

C.2. Business Contacts

If you interact with GCH or its Services on behalf of an organization, such as your employer or a business that you own or manage, that company is the Controller of your Personal Data, not GCH. Your Personal Data may form a part of your organization's GCH Client account data and processed for support of the Services we provide to that Client. You can read about how we process Client account data, such as your business email or other business contact information below. If you want to learn how our Client, your employer, handles your Personal Data, we encourage you to read that Client entity's specific privacy policies and notices.

GCH may in some limited circumstances act as the Controller of your Personal Data where GCH determines the business purpose for Data use. For example, GCH is the Controller of Data for any non-business interactions with us, such as visits to the Site or interactions with our Services in your personal capacity.

C.3. Site Visitors

If you are a Site Visitor, we act as the Controller of the information we collect directly or automatically as you navigate our Site. However, the Site may contain links to other websites, applications, and services from third parties. The privacy and data security practices of those third-party sites are governed by the privacy policies of those third parties, and not by GCH.

C.4. Employees, Job Applicants, and Contractors

If you are a GCH employee, completing our employee on-boarding process, a Job Applicant, or a contractor working for us, GCH will be the Controller of the Data we collect from you in that capacity, including through your use of the Site or our Services. However, if you are a GCH employee, completing our employee on-boarding processes, or a contractor working for us, any Data we collect from you in that capacity is governed by our internal policies, not this Privacy Notice.

D. Our Collection, Use, and Disclosure of Personal Data

D.1. Data Minimization and Use

GCH requires a minimal amount of Personal Data to provide our Services, including the Site. If you choose to share more information, GCH will process that Data according to the purpose for which it was provided and with the same limitations of purpose. GCH does not sell Personal Data and does not share Personal Data with third parties for those third parties' own business interests.

We do disclose the Personal Data we collect to our service providers to support our Services and operations as a business (e.g. to coordinate with payment processors, to manage the Site and present Site content, or to host and process data for our Services). We may also use Data to detect, prevent, or investigate security incidents, fraud, or misuse of our Site and Services.

D.2. What Personal Data Does GCH Collect?

The Personal Data GCH collects is generally determined by you and your interaction with us, our Clients, partners, third-party service providers and other resources. If you send a request for information to us about our business, we collect and use the information provided in your request to respond to that request. The Site may use technologies such as scripts, web beacons, and log files (cookies) that store bits of information used to help make our Site work and to operate and augment the effectiveness of our Site and Services. GCH does not knowingly track your activities across the internet and GCH does not purposefully collect or process consumer-related Personal Data. We collect Personal Data from our Site Visitors, Clients, prospective Clients, vendors, and Job Applicants in the United States, and our Site is intended for those parties.

D.3. How and Where does GCH collect Personal Data?

GCH collects business-related Personal Data from Job Applicants, potential Clients, Clients, participants at events, business partners and vendors and their employees, advisors, contractors, and individuals who choose to use our business Services on others behalf who:

  • Visit our Site
  • Communicate with us, such as by online form, email, phone, or mail
  • Use our Services as a Client
  • Register for, attend or otherwise take part in events where we are present
  • Download or otherwise engage our content or publications
  • Submit an inquiry about an invoice, order, etc.
  • Post on a third-party service where we have a profile or presence, such as on social media
  • Engage with our customer service personnel or other employees
  • Apply to work with us, view or share job postings or
  • Work at a Client or supplier of ours and interact with our company in the course of doing business or contemplating doing business with us.

a. We collect Personal Data from a variety of sources, including but not limited to:

  1. Directly from the person who is the subject of the Personal Data;
  2. Publicly available sources (such as a voting record, or your business information);
  3. Service providers for marketing and business outreach;
  4. Business Clients, service providers and/or vendors; and
  5. The device used to visit the Site, your network, or some limited data from cookies and other online technologies, as described in our Cookie Notice.

b. What types of Personal Data do we collect?

i. Identifying Information

Collected to process an inquiry, request for information, or purchase, including for example, name, business email address, and company billing address. When you submit a job application through the Site, we collect your name, email address, phone number, cover letter, and CV or Resume that you upload.

ii. Location Information

We can always detect where the Site is accessed from based on IP address, which gives us a general idea of device or network location, like country, city, or zip code. We may also collect location information such as zip code from you directly, if you provide it to us.

iii. Sensitive Data Not for Inferring Characteristics

We collect identifying information, including sensitive Data such as government identifiers and other sensitive Data, limited to the employment context to the extent permitted or required by applicable law.

iv. Event Information

We collect information if you sign up for events, such as contact information and mailing address. We may also collect Personal Data you provide to us during an interaction at a webinar, or an industry event or trade show.

v. Device Information

We collect information about the device you use to access our Services and your interactions with our Services. Examples include:

  • Technical information like your device and browser type, operating system, and system configuration.
  • Information about how a device has interacted with our Site, including the pages accessed, links clicked, forms completed, date and time stamps associated with usage, referring website, search engine queries used to get to our Site, content viewed, shared, or downloaded, and other technical information.
  • We may look at how often you visit the Site and where you accessed it from based on your IP address to get a general idea of your location, such as zip code and time zone. We might also recognize that it is you if you use different devices to access the Site.
  • We also collect information about how you use the Site, like your Site activity, searches, and browsing information.
vi. Commercial Information

Collected when you engage with our Services, including details about the Services utilized, considered, or other inquiries.

vii. Internet or other Network Activity Information

This information is either automatically collected or is customer-initiated. If you use our Site, we may gather data about the browser you use, files viewed, and date/time stamps associated with your usage.

viii. Communication Information

When you contact a member of our team via email, we collect contact details and information included in your email. When you report a problem with our Site or Services, we will collect contact information along with a description of the problem. If you call us, we may collect your phone number and other information you share with a member of our team.

ix. Other Information

We record calls to our customer service team to control or improve quality and operations. We do not analyze voice recordings to identify anyone.

D.4. How does GCH use the Personal Data it Collects?

a. GCH collects Personal Data for a number of purposes, including but not limited to the following:

i. To Provide our Services
  • Complete, fulfill, manage, and communicate about your use or engagement of the Services;
  • Set up and support your account in our system;
  • Communicate about the Services, or any experience and feedback related to the Services;
  • Provide customer service; and
  • Manage any communications with you.
ii. Internal operations
  • Improve effectiveness of our Site, Services, and customer service;
  • Conduct research for our operations and Services; and
  • Perform other logistics, digital coordination and operation activities as needed.
iii. Payment processing
  • Coordinate with service providers to process Client payments and address inquiries or about purchases and Services; and
  • Managing Client accounts, credit, and other transactional information.
iv. Security, compliance, legal obligations, and fraud prevention
  • Protect our assets (on and offline) and prevent fraudulent activities or activities that violate our policies or agreements;
  • Validate credentials and authenticate users;
  • Protect the security and integrity of our Services and our data; and
  • Assist any law enforcement and respond to legal/regulatory inquiries, if necessary.
v. Marketing, promotions and advertising
  • Send information about our Services and offers; and
  • Oversee any offers, surveys, or the like.
vi. Anonymized or De-Identified Uses

To the extent we anonymize or de-identify Data, we will not attempt to re-identify it.

b. Sensitive Personal Data

GCH does not use or disclose sensitive Personal Data except for limited purposes authorized by law or with your consent. For example, GCH may collect a government ID number for employment purposes, or a tax ID number to provide certain products or Services. Such uses of sensitive Personal Data does not afford rights to limit GCH's processing of sensitive Personal Data for these purposes, although we may nonetheless ask for consent or provide notice and choice about how the information is processed depending on the relevant context.

c. Sometimes Information is Vital

Where we need to collect and use Personal Data by law, or to complete a transaction or fulfill a contract with your company, and you fail to provide the Personal Data required such deficiency is likely to prevent us from meeting certain obligations of our contract or relationship with your company.

d. Other People's Privacy

If you provide us with Personal Data relating to another person, you must inform them directly of the sharing of their information with GCH, our identity, why their information is required, and how it will be used, and obtained their consent to use and disclose their information to GCH. The other person must have given consent to you to share their information with us. THEY have to consent. Please know you cannot consent for them.

e. Information We Generate or Collect Automatically

When you visit our Site, we and our service providers automatically collect data using cookies. This information is used to present Site content, to improve navigation on our Site, and for Site security. We do not knowingly sell this information to third parties. Our Cookie Notice has more information about how we use these technologies.

f. Marketing Information

We may use publicly available information about gathered through services like LinkedIn, or other publicly available sources, or we may obtain information from third party providers. We use this data, such as company size or website URL, to understand our customers, business contacts, and industry. We may use this type of information to reach out to potential candidates for roles at GCH.

D.5. How Long We Store Your Data

We retain the Personal Data we collect for the length of time necessary to fulfill our obligations or conclude our relationship with you and your organization, or if there is a legitimate and lawful business purpose in accordance with our record retention policies and applicable laws and regulations. When we have no ongoing legitimate business need to use the information, we will either delete or anonymize it or, if this is not possible (for example, because it has been stored in backup archives), we will securely store and isolate it from further use until deletion is possible. Authorized requests to delete Personal Data from Client account data will be honored unless deleting such information will prevent us from carrying out necessary business functions, such as billing for Services, calculating taxes, or conducting audits.

E. How GCH Shares Personal Data

We do not sell your Personal Data.

GCH does not knowingly allow Personal Data to be used by third parties for their own purposes, including their own marketing purposes or to "share" Personal Data for behavioral advertising.

In the circumstances described below, we disclose (or permit others to directly collect) information about you. Here are some of the ways that your Data may be shared:

We may disclose "blinded" aggregated data and user statistics without restriction. Blinded data is data that does not identify any individual.

e. To Service Providers

We may disclose Personal Data that we collect or that you provide to service providers and other third parties we use to support our business. We occasionally hire other companies to provide limited Services on our behalf, such as Site development and operation including presenting Site content, managing form submissions and browsing sessions; sending postal mail or email; Site optimization; providing Site security; fraud detection; facilitating marketing; processing payments; and processing Data. We provide those companies only the information they need to deliver the service to us or on our behalf.

f. In Special Cases

GCH and our service providers may disclose, access, or monitor your Personal Data in special cases, such as the following:

  • When we believe we must disclose Data to identify, contact or bring legal action against someone who may be violating an agreement with us, or may be causing injury to or interference with our rights or property, other Site visitors or customers and their Data, or anyone else who may be harmed by such activities.
  • When we believe in good faith that the law requires it.
  • For administrative and other purposes we deem necessary to maintain, service and improve our products and Services and our information security. This includes third party partners and service providers we use to enable the detection of devices connected with fraud and other types of information security vulnerabilities, to prevent fraud, security threats and illegal or malicious behavior, and to enhance security on our Site and other pages on the Internet.
  • In the event GCH buys or sells a businesses or assets, in such a transaction, confidential business Data generally is one of the transferred business assets. In the event of a transaction involving the sale of some or all of GCH's businesses, Client and Site Visitor Data may be one of the transferred assets and may be disclosed in connection with negotiations relating to a proposed transaction. In such case, the transferred Data may become subject to a different privacy notice.

F. How to Make Choices about Your Personal Data

F.1. The State Privacy Laws

GCH does business in North America. We do not solicit business or contact businesses or consumers outside of North America at this time. We do not collect Personal Data from residents of the United Kingdom or the European Union.

Residents of certain U.S. states may have rights (now or in the future) under privacy laws in effect in their state.

U.S. state privacy laws (State Privacy Laws) generally apply to Consumers who are natural persons acting in their personal or household capacities. The State Privacy Laws (other than the CCPA, for California residents and covered businesses), do not apply to Personal Data collected in the business-to-business (B2B), workforce, or employment contexts. This means that if you interact with GCH as a contractor, employee, or business representative of your organization, Data we collect or process from those interactions is generally not tied to Personal Data rights under State Privacy Laws (except for the CCPA, if applicable to the individual and to the business). We may not process privacy requests in cases where such State Privacy Law do not apply.

Business vs Commercial Purposes

When you are acting as business representative of an organization, we generally collect, retain, and use your Personal Data for business purposes and limited, if any, commercial purposes. Business purposes generally are not tied to an opt-out right under the State Privacy Laws because they do not implicate a sale, sharing or targeted advertising of a consumer's Data as defined under those laws.

Commercial purposes, on the other hand, generally trigger opt-out rights for consumers under the State Privacy Laws, particularly where sales, sharing, or targeted advertising of a consumer's Personal Data is involved. An example is where a third-party business collects a consumer's Personal Data using cookies, and that Data is used for certain advertising purposes.

However:

  • GCH does not knowingly sell or allow third parties to sell your information.
  • GCH does not knowingly share Personal Data for purposes of targeted advertising.
  • GCH does not knowingly use technologies to track an individual's behavior across the internet and derive value from use of such technologies.
  • GCH does use limited technology to obtain limited information about how a Site visitor interacts with our Site.

While consumers may be covered by an applicable State Privacy Law, some of the State Privacy Laws may not apply to GCH due to the scope of our business and limited number of interactions with consumer residents in certain states.

We will adhere to U.S. State Privacy Law rights to the extent that they apply to you and to us.

F.2. Exercising your privacy rights under applicable law

In the event we hold Consumer Personal Data about you that is subject to applicable US Privacy Laws, if you wish to access, correct, update, limit the use of sensitive Personal Data, or request deletion of your Personal Data, you can do so by using the Web Form provided under the Contact GCH heading at the top of this Notice.

We will of course need to verify you are who you say you are before we provide access (to anyone, including an Authorized Agent) to your Personal Data. To protect your privacy, such verification by GCH may vary, depending on the sensitivity of the information. We use the information you provide to match the identifying information, if any, already maintained by GCH. An Authorized Agent is a natural person or an entity registered with the relevant government agency, such as a Secretary of State, who you have authorized to act on your behalf. GCH requires you to confirm that you have provided the Authorized Agent permission to submit the request, including a signed permission. Signed means the written attestation, declaration, or permission has either been physically signed or provided electronically pursuant to the Uniform Electronic Transactions Act. GCH may deny a request from an Authorized Agent who does not submit the requisite proof that they have been authorized to act on your behalf.

GCH does not discriminate against anyone for exercising privacy rights under applicable law.

F.3. Supplemental Notice to California Residents

California Civil Code Section 1798.83 permits individuals who are California residents that have a business relationship with us to request certain information regarding our disclosure of Personal Data to third parties for their direct marketing purposes. To make such a request, please contact us using the Web Form in the Contact GCH section at the top of this Notice. Make sure to state that you are a California resident.

F.4. Supplemental Notice to Nevada Residents

Nevada Rev. Stat. § 603A.345, permits consumers in Nevada to opt-out of the sale of certain kinds of Personal Data. A sale under Nevada law is the transfer of this Personal Data to third parties for monetary consideration so these third parties can then re-sell or license the sold Data. We do not sell your Personal Data to third parties as defined in Nevada law.

G. How GCH Secures Personal Data

Use of any online network or system inherently involves risks of unauthorized disclosure or exposure. GCH has taken appropriate technical, organizational and administrative security measures in an effort to protect the security, confidentiality and integrity of information and Data provided to GCH. We use industry standard encryption, security controls and system monitoring to keep access restricted and our data, including your Personal Data, secure.

H. Cookies

GCH's Site uses certain technologies such as cookies, scripts, and beacons (collectively referred to as cookies in this Notice) which are described in our Cookie Notice. The information we collect using cookies provides us a better understanding of the visitors who visit our Site, where they come from, and what content on our Site is of interest to them. This information is used for our internal purposes, to improve the quality and relevance of our Site and Services to our Site visitors, and to enhance the security of our Site. We also use this information for detection and prevention of fraud, security threats or other illegal or suspicious behavior on our Site.

I. Withdrawal of Consent

If we have collected and used your Personal Data with your consent, you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the use conducted in reliance on lawful processing grounds other than consent.

J. Children

We do not knowingly collect information about children under 18.

No child under 18 should use this Site. Our Services and Site are not in any way directed to individuals under 18 and we do not knowingly collect Personal Data from those under 18. If you are a parent or guardian and believe your child has provided us with Personal Data without your consent, please contact us by using the Web Form in the Contact GCH section at the top of this Notice, and we will work to delete any such Personal Data from our systems.

K. Changes to our Privacy Notice

GCH will review and may change this Privacy Notice from time to time. When we do, the most current version will be available at www.gchtech.com/privacy-policy with notice of the date of the most recent update. We will post the new one on this page. We will handle your Personal Data in accordance with the Privacy Notice in effect at the time it was processed unless GCH provides a new Notice on our Site or obtains your consent.

L. GCH's Cookie Notice

GCH respects the privacy of visitors using our Site. This Cookie Notice is part of our Privacy Notice and provides you with information about cookies or other technologies we use and our purposes for using them.

Like most other sites, our Site uses cookies. You should be aware that refusing certain types of cookies may impact your experience of our Site.

Our Site does not recognize the Global Privacy Control (GPC) signal or support "do not track" (DNT) codes, as there is no sale or tracking activity of Personal Data to block, and thus no purpose for implementing these settings on our Site.

L.3. How Long Do Cookies Last?

Except for Strictly Necessary cookies, the cookies we run on our Site will expire as follows:

Session Cookies

They allow site operators to follow a user's actions through a browser session. A browser session begins when a user opens the browser window and ends when the browser window is closed. Session cookies are temporary. Once the browser is closed, all session cookies are deleted.

Persistent Cookies

These remain on a visitor's device for a time period set by the cookie. They are activated each time a user visits the site that created that cookie.

L.4. What Cookies Does GCH Use & Why?

The cookies used on our Site are categorized as follows:

  • Strictly necessary
  • Functional

We do not use Analytics, Targeting or Social Media cookies.

a. Strictly Necessary Cookies

These cookies are necessary for the Site to function and cannot be switched off in our systems. They allow you to move around the Site and use essential features. Without these cookies, we cannot provide the requested Services. These cookies do not store information that could specifically identify you.

We use Strictly Necessary Cookies for purposes such as to:

  • Detect and manage bot access to our Site by permitting good bots like search engines while blocking bad bots like third-party scrapers and spam bots;
  • Present Site content;
  • Ensure a user connects to the right service if a change is made;
  • Detect spam, fraud, and abuse; and
  • Security purposes.

You can set your browser to block or alert you about these cookies. However, if they are blocked, GCH cannot guarantee performance of the Site or security during a visit.

b. Functional Cookies
